Every Client Deserves a Defence Built on Law, Not Fear
Being summoned by investigators, served with a lawsuit or named in a bankruptcy petition is one of the most stressful moments in a person’s or a company’s life. INKRAH Legal Defence exists for that moment. Since 2020 we have defended individuals, families, directors and businesses, holding firmly to the presumption of innocence, the right to be heard and the principle that no one may be punished or held liable except in accordance with law.
What sets our defence apart is the research behind it. Each pleading is prepared with the same discipline as an article in the INKRAH Law Journal: the elements of every charge or claim are tested one by one against the evidence, the statute, the case law and legal doctrine, so that the court is given clear and persuasive reasons to decide in our client’s favour.
Defending Clients Across the Law
Criminal, civil, commercial, insolvency, employment, administrative and constitutional matters.
Criminal Defence
From the first summons by the police to the final appeal: accompanying clients during questioning, challenging unlawful arrest, detention or seizure through pre-trial review (praperadilan), answering the indictment with an objection (eksepsi), testing every witness and exhibit at trial, and delivering a fully reasoned defence plea (pledoi), followed by appeal (banding), cassation (kasasi) and case review (peninjauan kembali) where justice requires it.
White-Collar, Corruption & Cyber Cases
Defending directors, officials and professionals accused of fraud, embezzlement, corruption, money laundering, tax offences, capital market offences and offences under the Electronic Information and Transactions Law, including defamation and data cases, where the line between business risk and criminal liability must be drawn with precision.
Civil Defence
Acting for defendants in civil suits: claims for breach of contract (wanprestasi), tort (perbuatan melawan hukum), land and property disputes, inheritance and family property, and claims for damages. We answer the claim, raise counter-claims (rekonvensi) where they exist, and resist provisional attachment (sita jaminan) of our client’s assets.
Commercial & Business Disputes
Defending companies, shareholders, directors and commissioners in shareholder and joint-venture disputes, claims against management, distribution and agency terminations, construction claims, consumer complaints before the BPSK, intellectual property infringement claims and arbitration in which our client is the respondent.
Insolvency Defence
Protecting debtors and their directors against suspension of debt payment (PKPU) and bankruptcy petitions in the Commercial Court: contesting whether the debt is simple to prove, negotiating a composition plan (perdamaian) with creditors and defending against claims of personal liability.
Employment & Industrial Relations
Representing employers and employees in termination disputes, severance claims and collective disputes, from bipartite and tripartite mediation to the Industrial Relations Court and the Supreme Court.
Administrative & Regulatory Matters
Challenging government decisions before the State Administrative Court (PTUN), defending business licences against revocation, and representing clients in regulatory investigations, administrative sanctions and objections.
Constitutional & Judicial Review
Preparing petitions and expert legal arguments for the review of statutes before the Constitutional Court and of regulations before the Supreme Court, when a client’s rights depend on the validity of the rule itself.
How We Defend
Immediate Assessment
Within hours of instruction we review the summons, claim or charge, identify deadlines and secure the documents and evidence that must not be lost.
Defence Strategy
A written strategy sets out the facts, the applicable law, the strengths and weaknesses on both sides, the options (including settlement or restorative justice where available) and the likely costs.
Representation
We accompany the client at every examination and hearing, prepare objections, evidence, witnesses and experts, and draft every pleading with the same research discipline that underpins INKRAH’s scholarship.
Closing & Appeal
We close the case with a reasoned defence plea or conclusion, review the judgment the day it is pronounced, and advise immediately on appeal, cassation or case review.
