Ketentuan Umum

Article 1 — Definition of an Industrial Design

Desain Industri adalah suatu kreasi tentang bentuk, konfigurasi, atau komposisi garis atau warna, atau gabungannya yang berbentuk tiga dimensi atau dua dimensi yang memberikan kesan estetis dan dapat diwujudkan serta dapat dipakai untuk menghasilkan suatu produk, barang, komoditas industri, atau kerajinan tangan.

An industrial design is a creation of the shape, configuration or composition of lines or colours, or their combination, in three or two dimensions, giving an aesthetic impression and able to be realised and used to produce a product, good, industrial commodity or handicraft.

Article 2 — Novelty

(1) Hak Desain Industri diberikan untuk Desain Industri yang baru.

(2) Desain Industri dianggap baru apabila pada Tanggal Penerimaan, Desain Industri tersebut tidak sama dengan pengungkapan yang telah ada sebelumnya.

(1) An industrial-design right is granted for a new industrial design.

(2) An industrial design is deemed new if, on the filing date, it is not the same as any prior disclosure.

Jangka Waktu

Article 5 — Term of Protection

(1) Perlindungan terhadap Hak Desain Industri diberikan untuk jangka waktu 10 (sepuluh) tahun terhitung sejak Tanggal Penerimaan.
